The U.S. Dept. of Labor has issued a Request for Information (RFI) regarding the regulation impacting overtime pay. The RFI is intended to help the DOL evaluate the overtime rule pursuant to President Trump’s, E.O. 13777 which calls on federal agencies to review regulations for repeal, replacement, or modification that meet certain criteria. The overtime rule was last updated during the Obama Administration and changes, including the increase to the salary threshold, were set to take effect December 2016. Implementation of the rule has been postponed by the courts. The U.S. Dept. of Labor Secretary Acosta recently testified that he would be amenable to an increase in the salary threshold but at a lesser amount than the increase established by the Obama Administration that is now on hold.
